Linkaz is a digital marketplace that connects Employers (individuals and businesses seeking skilled service workers) with Workers and Agencies (independent service providers) across Kenya. By creating an account and using Linkaz, you agree to be bound by these Terms & Conditions. Please read them carefully.

These terms apply to all users of the Linkaz platform, including the mobile application and web portal.

1. The Linkaz Platform

Linkaz provides a technology platform — not employment. We are not an employer, staffing agency, or service provider. Workers and Agencies on Linkaz are independent contractors who set their own rates, availability, and service terms.

Worker Independence Disclaimer

All Workers and Agency members on Linkaz are independent service providers. Linkaz does not:

  • Employ, supervise, or direct any Worker

  • Guarantee the quality, timeliness, or outcome of any service

  • Take responsibility for agreements, warranties, or promises made between Workers and Employers

Employers engage Workers directly. Any service agreement is solely between the Employer and the Worker.

2. Account Registration
  • You must be at least 18 years old to create a Linkaz account.

  • You must provide accurate, current, and complete information during registration.

  • Your account is personal and non-transferable. You are responsible for all activity under your account.

  • Phone number verification is required. You must have access to the phone number you register with.

  • Linkaz may suspend accounts where information is found to be false or misleading.

3. Bookings & Payments

All payments for services booked through Linkaz must be made through the platform. Off-platform payments are strictly prohibited and may result in account suspension.

Workers set their own service rates. Linkaz may display suggested rates for guidance only. Linkaz charges a platform commission on completed bookings processed through Safe Pay — a percentage of the agreed amount, deducted from the Worker's payout. The percentage varies by job category, and Linkaz may vary it from time to time. The amount deducted is recorded on the payment record for each completed booking.

Immediate bookings require the Worker to respond within 15 minutes. Expired requests are automatically cancelled. Scheduled bookings must be accepted by the Worker before the agreed start date.

Safe Pay (Escrow)

Safe Pay is Linkaz's escrow payment system. The Employer funds the booking before work begins. Funds are held securely by Linkaz until the job is marked Complete. On completion, Linkaz deducts its commission and releases the remaining balance to the Worker. The Employer always pays the full agreed amount. If a booking is cancelled before work begins, funded escrow is returned to the Employer's Linkaz wallet.

Cash Payments

Cash payments are permitted but are not protected by Safe Pay. Disputes arising from cash transactions cannot be mediated by Linkaz.

4. Cancellations & Refunds

Cancellation policies depend on the booking status and timing. Safe Pay funds are refunded to the Employer's Linkaz wallet when a booking is cancelled before work begins. Refunds to a bank account or M-Pesa are subject to processing times and applicable fees. Linkaz reserves the right to deduct a dispute-handling fee from refunds where a formal investigation is conducted.

5. Disputes

Either party may raise a dispute on an in-progress Safe Pay booking. Disputes are reviewed by Linkaz moderators. We will make a good-faith effort to mediate, but our decisions are final within the platform. During a dispute, Safe Pay funds are frozen until resolution. Abusing the dispute system is a violation of these terms and may result in account suspension.

6. GPS Tracking & Journey Sharing

When a Worker accepts a booking and begins travelling to a job, they may share their live location with the Employer. Journey sharing is started explicitly by the Worker — location is never shared without their action. Journey data is stored temporarily for safety and dispute resolution purposes and deleted after 30 days.

7. Worker Verification

Workers offering services in safety-sensitive categories must be verified before appearing in Employer searches. Verification requires submission of valid identification and relevant certificates. Linkaz moderators review documents and may approve or reject applications. Verified status may be revoked if documents are found to be fraudulent or expired.

8. Agencies

Agencies are independent businesses that manage multiple Workers on the platform. Agency owners are responsible for the conduct of all members under their agency. Linkaz is not responsible for any Agency's internal employment, payment, or management practices.

9. Ratings & Reviews

Employers may rate and review Workers after a completed booking. Reviews must be honest and based on genuine experience. False reviews are prohibited. Workers with persistent poor ratings, verified complaints, or multiple no-shows are subject to account review or suspension.

10. Platform Conduct

All users must:

  • Treat others with respect. Harassment, discrimination, and abuse are not tolerated.

  • Not attempt to take transactions off-platform to avoid Linkaz's commission.

  • Not create multiple accounts or impersonate others.

  • Not engage in fraud, misrepresentation, or any illegal activity through the platform.

Violations may result in warnings, temporary suspension, or permanent removal from Linkaz.

11. Profile Boosts

Workers and Agencies may purchase Boost plans to increase their visibility in Employer searches. Boosts are non-refundable once activated. Linkaz does not guarantee any specific number of bookings as a result of a Boost.

12. Intellectual Property

All content on Linkaz — including the logo, design, code, and platform features — is the property of Linkaz. You may not copy, reproduce, or distribute any part of the platform without written permission.

13. Limitation of Liability

Linkaz's total liability to you for any claim arising from use of the platform is limited to the platform fees paid by you in the 90 days preceding the claim. We are not liable for indirect, incidental, or consequential damages.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of Linkaz after changes are posted constitutes your acceptance of the updated Terms. We will notify users of significant changes via the app.

15. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms will be subject to the jurisdiction of the Kenyan courts.
